تشير هذه الرسالة تدور حول التعرف على المبادئ القانونية التي أسَّسها نبيُّ الله يوسف (عليه السلام) و التي تطبق في العصور الحديثة و في ظل الدولة الحديثة: من خلال سيرته الشخصية و ما تعرض له من أحداث و مواقف وُضع خلالها في مراكز قانونية و قام باستخراج قواعد قانونية طبَّقها بكل فطرة: هذه القواعد و المبادئ القانونية عرفتها البشرية الحديثة و طبقتها على إنها اكتشاف خطير لمبادئ القانون: و ما زالت هذه الدول تطبق هذه القواعد و تأخذ بها في علاقاتها القانونية و التشريعية: سواء فى مجال القانون العام أو فى مجال القانون الخاص. فالقانون هو ذلك الإحساس الغريزي داخل الإنسان الذي حدَّد قواعد تنظيم سلوكه داخل الجماعة البشرية. و قد خرجت القواعد القانونية إلى العالم البشري بخروج الجانب الغريزي سالف الذكر إلى العالم الخارجي لتكوِّن منه قواعد قانونية عامة مجردة و ملزمة فى و قت واحد: تولت صياغتها المجالس التشريعية: ثم تطبقها فيما بعد السلطة القضائية: و تعمل على إنفاذها السلطة التنفيذية. و على الرغم من أن القواعد القانونية ينبغي أن تتطور بتطور الأزمان و المجتمعات؛ حتى تتماشى مع هذه الأزمان و تتفق مع حاجات المجتمع: فإن مجموعة من المبادئ القانونية قد ظهرت - أو نحاول أن نظهرها و نميط اللثام عنها - أُسست و وردت في سورة يوسف و ظلت هذه المبادئ تطبق منذ قديم الزمان: و لا تزال أساسًا للتشريعات التي يسنُّها المشرِّعون في العصر الحديث: و يطبقها القضاء فى مراحل التقاضى |
