تبلورت هذه الدراسة حول الدعاوى واجبة الشهر في ظل تشريعات الشهر العقاري والتشريعات المقارنة في باب تمهيدي عن التطور التاريخي لشهر الدعاوى المتعلقة بالحقوق<br/>العينية العقارية في النظم القانونية المختلفة القديمة منها والحديثة، تم في قسمين: الأول: عن أنواع الدعاوى واجبة الشهر، ويتناول دراسة هذه الدعاوى سواء في ظل قانون<br/>تنظيم الشهر العقاري (الشهر الشخصي) أو في ظل قانون السجل العيني. والقسم الثاني: يتناول إجراءات شهر الدعاوى المتعلقة بالحقوق العينية العقارية والآثار<br/>المترتبة على شهر هذه الدعاوى وشهر الأحكام الصادرة فيها. |

This thesis focused on the actions that have to be notarized under the successive legislations regulating the notarization of real estate and comparative legislations. It consists of an introductory chapter and two sections. The introductory chapter explores the historical development of the regime of notarizing actions related to real estate in various legal systems, whether old or modern systems. The first section shows the actions that have to be notarized under both the Law No. 114 of 1946 on Organizing the Real Estate Notarization, and the Law No. 142 of 1964 on Real Estate Registry. Demonstrating the procedures to notarize the judicial actions of real estate, and the effects of the notarization is the topic of the second section. |
