يعتبر العلم بقواعد المنطق وسيلة القاضي لضبط تفكيره وسلامة استنتاجه ، بحيث يبتعد فهمه لواقعة الدعوى والأدلة القائمة فيها عن الشطط : فالقواعد المنطيقة بالنسبة للقاضي تكون كالضوء الذي ينشر شعاعه على واقعات الدعوى والأدلة القائمة فيها وعلى تطبيق القانون عليها، ويجب دائماً أن تكون المقدمات التي جعلها القاضي الأساس لحكمه سواء كان ذلك من حيث الواقع ، أم من حيث القانون مؤدية وفق قواعد العقل والمنطق إلى النتيجة التي انتهى إليها، بحيث يتحقق التلازم والاتاق والوحدة المنطقية بين هذه المقدمات وتلك النتيجة ، فيستطيع بهذا الفهم الصحيح أن يستنبط منها النتائج الصحيحة وهذه القواعد إذا سار عليها القاضي في مرحلة تكوين اقتناعه يترتب عليها ضبط تفكيره وحمايته من الاقتناع المتعجل أو القاصر أو الفاسد، فيصل عن طريقها إلى الرأي الصحيح الذي يحم به الدعوى المعروضة على القاضي.<br/>لما كان ذلك وكان علم المنطق من العلوم الضابطة للتفكير والمؤدية إلى اتساقه وصحته، فإنه يمثل أهمية كبيرة للقاضي المدني والجنائي على حد سواء عند تكوين عقيدتهما ، فهو يمدهما بقواعد الاستدلال المنطقي : التي يكون من شأنها أن تضبط فكرهما وتصون استدلالهما من الخطأ : مما يؤدى إلى صحة الحكم الذي يعتمد بنائه على هذه القواعد .<br/>إن أهمية المنطق القانوني لا تقف عند قاضي الموضوع ، وإنما يعتمدها قضاة محكمة النقض، فتحقق علم هؤلاء القضاة بقواعد المنطق يمكنهم من مراقبة مقدمات الحكم المطعون فيه والتحقق فيما إذا كانت هذه المقدمات تسير في ركب قواعد الاستدلال المنطقى أم أنه قدر عليها الفساد في الاستدلال لمخالفتها لقواعد العقل والمنطق<br/>ومن هنا كانت دراستنا في هذا البحث تدور في فلك الدراسات الفلسفية لعلم المنطق ، مبتعدين بقدر الإمكان عن النظريات الميتافيزيقية الجدلية : والتي لا تصب في وعاء النفط العملي<br/>والإطار الحياتي لمفهوم المنطق القانوني . حيث جاءت الدراسة لهذا العلم من منظور علمي وعملي يستلهم الغاية من البحث في حياتنا اليومية ودراستنا القانونية ، خاصة في مجال الأحكام القضائية، وأن إشكالية البحث تقوم على كيفية الموائمة بين العدل كنظام، والمنطق كعدالة هي الغاية من التشريع . |

Knowledge of the rules of logic is the judge's mean of controlling his thinking and the validity of his conclusion, so that his understanding of the event of the case and the evidences in it is far from thinking in multiple directions, for the judge, the logical rules are like the light that spreads its beam on the facts of the case and the evidence in it and on the application of the law to it.<br/>The introductions that the judge made the basis for his judgment, whether in reality or in terms of law, must always lead according to the rules of reason and logic to the result that he reached, so that the coherence, consistency and logical unity between these introductions and that result are achieved, and with this correct understanding, he can deduce the correct results.<br/>If these rules are followed by the judge in the stage of forming his conviction, then he must control his thinking and protect him from hasty, minor or corrupt conviction, and then through them he can reach to the correct opinion that will settle the case presented to the judge.<br/>Considering this, and considering logic as a controlling science for thinking and leading to its consistency and validity, it is of great importance to both civil ard criminal judges when forming their faith, where It provides them with the rules of logicalreasoning, that would control their thinking and safeguard their reasoning from error, which leads to the validity of the judgment that he adopts in these rules.<br/>The importance of legal logic does not stop with the subject judge, but rather is approved by the judges of the Court of Cassation, since the knowledge of these judges of the rules of logic enables them to monitor the introductions of the contested judgment and to verify whether these introductions are proceeding with the rules of logical reasoning or whether it was imposed on it the corruption in nference, because it violates the rules of reason and logic.<br/>Hence our study in this research revolves in the orbit of philosophical studies of logic. as far away as possible from dialectical metaphysical theories, which do not flow into the bowl of practical style and the life framework of the concept of legal logic.<br/>Where the study of this science was from a scientific and practical perspective that inspire the purpose of research in our daily life and our legal study, especially in the field of judicial rulings, and that the problem of research is based on how to harmonize justice as a system, and logic as justice is the purpose of the legislation. |
