تناولت هذه الدراسة موضوع المسؤولية المدنية لطبيب الجراحة فى القانون المدنى الأردني، و هى دراسة مقارنة بين القانون الأردنى و القانون المصرى و القانون الفرنسى وفقاً لأحدث تطوراته. و قد حرصت هذه الدراسة على إبراز التنظيم القانونى للعمل الطبى الذى يضطلع به الطبيب الجراح فى إطار العمليات الجراحية، و هو الأمر الذى استلزم ضرورة تحديد الضوابط التى تحكم العلاقة ما بين الطبيب الجراح و المريض، و لا سيما أن هذه العلاقة على قدر كبير من الأهمية سواء من الوجهة النظرية حيث تمثل موضوعات المسؤولية الطبية ميداناً رحباً لتطور قواعد القانون فى معالجة مستجدات العصر الحديث و خصوصاً المستجدات الطبية، أو من الوجهة العملية حيث تبدو علاقة المريض بالطبيب الجراح هى النموذج الأمثل للعلاقات الإنسانية فى أسمى معانيها، فبالرغم من أن مهنة الطب تتمتع بقدسية لا حد لها، و أن مقتضيات ممارسة هذه المهنة أن يتمتع الطبيب الجراح بقدر كبير من الحرية و الاطمئنان بما يمكنه من مباشرة عمله بثبات و ثقة، إلا أن حياة الإنسان سواء كان سليماً أو مريضاً: و سلامة بدنه تعد من أهم الحقوق التى حرصت التشريعات المختلفة على حمايتها، إذ يتوجب على الطبيب الجراح الاهتمام بالمريض و بذل العناية اللازمة له وفقاً للأصول و القواعد المستقرة فى علم الطب، فأى حق أسمى و أعظم وأجدر بالبحث من حق الإنسان فى الحياة و سلامة بدنه من الأضرار التى قد تنجم عن الأخطاء الطبية. كما سعت هذه الدراسة إلى تحديد الالتزامات الفنية و الإنسانية التى تقع على عاتق الطبيب الجراح، و التى يترتب على إخلاله بها قيام مسؤوليته المدنية، التى تتمثل فى التزامه بتعويض المريض المضرور. و فى سبيل توفير البيئة المناسبة للطبيب الجراح لكى يمارس عمله بكل ثقة و ثبات، تدخل المشرع فى فرنسا و بعض الدول العربية و جعل التأمين من المسؤولية الطبية إجبارياً |

This study deals with the subject of the civil responsibility of the surgeon in Jordanian civil law, which is a comparative study between Jordanian law, Egyptian law and French law according to the latest developments.<br/>This study was keen to highlight the legal organization of the medical work carried out by the surgeon in the course of surgery, Which necessitates the need to determine the controls governing the relationship between the surgeon and the patient, especially as this relationship is of great importance both theoretically where the subjects of medical responsibility is a wide field for the development of the rules of law in dealing with the latest developments in modern times, especially medical developments, or from a practical point of view where the patient's relationship with the surgeon seems to be the ideal model of human relations in the highest sense, although the medical profession has unlimited sanctity, and that the requirements of this profession to have a surgeon with great freedom and reassurance to enable him to work steadily And trust, but the life of human being, whether healthy or sick, and the safety of his body is one of the most important rights that different legislation to protect them. The surgeon must pay attention to the patient and take care of him according to the established principles and rules in the science of medicine. So.., what is the highest right and greater and better than the search for the human right to life and the safety of his body from the damage that may result from medical errors!<br/>The study also sought to determine the technical and humanitarian obligations of the surgeon, whose failure to fulfill his civil responsibility, which is his obligation to compensate the injured patient. In order to provide the appropriate environment for the surgeon to work with confidence and firmness, the legislator intervenes in France and some Arab countries and makes the insurance from medical responsibility mandatory. |
