| Summary, etc. | إذا كان كل خطأ سبب ضررًا للغير يلزم من ارتكبه بالتعويض: هو المبدأ العام للمسئولية المدنية فى كل من مصر و فرنسا: فإن هذه الدراسة تهدف إلى نفى ذلك المبدأ من خلال حلول بديلة عن فكرة الخطأ كمبدأ عام: فكان لازمًا الاستعانة بفكرة الضرر الذى يُعد محور المسئولية الموضوعية كبديل للخطأ فى مجال المسئولية المدنية: باعتبار أن الضرر هو مناط التعويض: و الذى يمثل ركن أساسي لا غنى عنه فى أركان المسئولية المدنية بصورتها التقليدية. و بالنظر لما اُستحدث من تطورات اقتصادية و اجتماعية و تكنولوجية و علمية: أدت إلى استحداث أضرار أخرى تصيب المجتمع فى أفراده أو أموالهم و تؤثر تأثيرًا مباشرًا على النواحى الإنسانية بصورة عظيمة: و ما نتج عنها من عجز قواعد المسئولية المدنية بصورتها التقليدية لجبر تلك الأضرار بسبب صعوبة إثبات الخطأ من ناحية: و صعوبة تحديد المسئول عنه من ناحية أخرى: و تمثلت هذه الحلول في إحلال فكرة الضرر محل فكرة الخطأ فى تلك الحالات المستحدثة و الذى يقوم على أساس من نظريتي تحمل التبعة و الضمان |

| Summary, etc. | The fact that if a fault causes damage to others, the fault doer shall compensate the victim constitutes the general principle of civil liability in Egypt and France. This study attempts to deny this principle through alternative solutions to the idea of fault as a general principle. Hence, it becomes incumbent to use the idea of damage, which is the axis of the objective liability as an alternative to fault in the field of civil liability, as damage is the subject of reparation, which is an indispensable cornerstone of the pillars of civil liability in its traditional form.<br/>In light of recent economic, social, technological and scientific developments that led to the emergence of other damages immediately affecting citizens and properties as well as humanitarian aspects. This, in turn, reveals the shortcomings of civil liability in its traditional form to compensate these damages on one hand and to define the fault doer on the other hand. Therefore, new alternative solutions should be sought.<br/>These solutions are to replace the notion of damage with the idea of fault in those newly created cases based on theories of liability and security. The objective of this study is to ensure the right of individuals within society to obtain compensation that compels the damage suffered either in themselves or in their funds without incurring the burden of proving fault on the part of the responsible person. |
