تعد القرينة القضائية من أدلة الاثبات الغير مباشرة: ذلك ان مسألة الحصول على الأدلة التي تنصب مباشرة على الواقعة محل البحث غالبا ما يكون متعذرا ان لم يكن مستحيلا: ذلك ان الجريمة في الأصل ترتكب بطريقة تضيع معالمها: أو لعدم وجود شهود أو اعتراف: فهنا يتحتم على القاضي الجنائي تحكيم عقله باستخدام ضوابط الاستدلال: واصول المنطق السليم للوصول الى الجزم واليقين: بصورة تتطابق مع الحقيقة والواقع: وبما نص عليه المشرع: ونادى به الفقه: واخذ به القضاء. وبناءا على ذلك فان للقرائن القضائية في ميدان الاثبات الجنائي دور أصيل: أو معزز ومكمل للأدلة الاخرى: بل أصبحت من أكثر الوسائل اعتمادا في العصر الحالي. والذي يزيد من أهمية القرينة القضائية في مجال الاثبات الجنائي هو مدى تأثيرها في مصداقية الأدلة الاخرى: كالشهادة: والاعتراف. على الرغم من ان التشريعات محل الدراسة قد اعتمدت على مبدأ الاقتناع القضائي: الا انها اختلفت من خلال نصوصها التشريعية: وتطبيقاتها القضائية: واتجاهاتها القضائية حول الاعتماد على القرينة القضائية كدليل اثبات أصيل: خصوصها في حالة وجود قرينة واحدة |

The judicial prosemption is one of the indirect evidences, because the question of abtaining the proofs dealing directly with the fact subject of research is very difficult.<br/>In fact, the crime is committed in a manner which disappears or hides its elements, unless there is witnesses or arew, in this case the penal judge is obligateed to use his analysis by using the jeduction, and the principles of good logic to reach to the truth which is identical with the factuel facts and the intention of the legislator and the doctrine and jurisprudence.<br/>Consequently, the judicial presomputions play an essential role, helping or complementary to other evidences, and they became of current application in our time.<br/>Theyare very important in renforcing the other evidence such as the witness and the aview Nevertheless, the legislations which were subject of this study has adopted the principle of judicial conviction, but they are different in their dispositions and their application and their judicial approaches about the adoption of the judicial presompution as principal evidence, specially, in the case of the sole presumption. |
