هذا البحث والذى تم تناوله بالدراسة من زوايا مختلفة: استعرضت فيه ماهية الأوراق المالية محل التداول فى سوق الأوراق المالية : ومدى قابليتها بمختلف أنواعها للرهن: فهى كمنقول تعطي حقوقًا مباشرة لمالكها في صورة عائد أو أرباح من ناحية ونصيب في الأصول بصفة عامة من ناحية أخرى. فإنها كذلك لا تستعصى على الرهن كأحد روافد حقوق الملكية تحت مظلة قانون سوق رأس المال: وقانون الإيداع والقيد المركزي: وقانون التجارة: وقانون البنك المركزى والنقد: مروراً باستعراض قواعد وإجراءات رهن الأوراق المالية: ثم آثار عملية رهن الأوراق المالية بالنسبة لجميع أطراف العلاقة : انتهاءاً بما تسمى عملية " شطب الرهن " أو " فك الرهن " مع توضيح آليات التنفيذ الجبرى على الأوراق المالية المرهونة وبيعها فى مصر وبعض البلدان الأخرى. |

This is a study that has been carried out from different aspects, presents the nature of securities traded in the stock market, and the extent to which they, of all types, are subjected to pledging. Since securities are movables, they give their possessor direct rights in the form of income or profits on the one hand, and in the form of a share in assets in general, on the other. However, pledging as one of the<br/>tributaries of the property rights may add to a greater benefit from securities under the umbrella of the Monetary Law, the Depository and Central Registration law, the Law of Trade, and the Law of Central Bank and the Cash. The study reviews and discusses the rules and procedures for securities pledge, the legal effects of securities pledge on all parties of the relationship; ending with the so-called "redemption", and the mechanisms of forced execution of the encumbered securities and their sale in Egypt and some other countries. |
