تناولنا في هذه الدراسة مبدأ الاختصاص الجنائي العالمي باعتباره آلية من الآليات القانونية المتاحة والقادرة على ضمان حق الضحايا في إنصاف قضائي فعال، ووضع حد لإفلات المجرمين من العقاب، حيث أضحى هذا المبدأ من المبادئ القانونية التي تحكم سريان النص الجنائي من حيث المكان في التشريعات الوطنية، مع تفرده عن باقي المبادئ القانونية الإقليمية الشخصية - العينية ، بكونه موضوع تتواجد جزئياته بين قواعد القانون الدولي العام والقوانين الجنائية الوطنية، بشكل يجعل إمكانية معالجته بصفة مستقلة عن أي منهما أمراً صعباً. |

This study has subject the principle of international penal competence as one of the legal possible mechanism to assure the right of the victims in effective justice and to put an end to escape of punishment. This principle has become one of principles ruling the application of penal text in the espace in the national legislations, but it is distinct from other legal principles: territorial, personal, real, as a subject which elements is dvised between international public law and national penal laws. That is why its study can not be separated from any of them. |
