يعتبر الدفاع الشرعي احدى الصور التى يتخذها حق الدولة في البقاء: ذلك ان المجتمع الدولي حتى مطلع العصور الحديثة كان يفتقر لتنظيم قانوني يحكم العلاقات بين الدول: وكان اللجوء الى القوة هي الأساس الذي يحكم العلاقات بين أعضاء المجتمع الدولي: وفي عصر التنظيم الدولي بدأ التفكير في تحريم الحروب: وبدأت هذه المحاولات في عهد عصبة الأمم: ثم ما لبثت أن تبلورت الفكرة بشكلها النهائي في عصر الأمم المتحدة التي نص ميثاقها على تحريم اللجوء الى القوة في العلاقات الدولية(م2/4): وعلى إستثناء الدفاع الشرعي من هذا التحريم(م51). ومما لاشك فيه أن حظر اللجوء إلى القوة في العلاقات الدولية: الذي أرسى مقتضياته ميثاق الأمم المتحدة لم يكن إلا ثمرة لما جاء بها الشرائع السماوية: وفي مقدمتها الشريعة الإسلامية: فالإسلام حرم اللجوء الى القوة في العلاقات الدولية كقاعدة عامة: وأجازه استثناءً في حالة واحدة: وهي حالة الدفاع الشرعي- الجهاد |

Self-defense is considered as one form taken by the State's right for survival, because until the beginning of the modern eras the international society lacked a legal organization which governs the relations between the state's and prohibits the resort to force in absolute terms. The resort to force was the principle which governs the relations between the international society members. where there were no international conventions that prohibits the use of force or threat of force. During the international organization era thoughts started in finding a mean for restricting the states freedom in resorting to war and attempting to through the responsibility of achieving the international peace and security at the burden of the international society as a whole. This started with the League of Nations Era followed by the idea took its final form in the United Nation Era whose pact stated the prohibition of the use of force in international relations and stated the self-defence as a exception of the prohibition of the use of force. There is no doubt that the prohibition of the use of force in international relations as state in the United Nations pact was only the product of what existed in the religious Sharea (law) headed by the Islamic Shari'a (law). This is because the origin as stated by the scholars in the international relations in Islam is peace which was permitted except in one case which is the case of the self-defense that is the holy war (Jihad). |
