تناولت الدراسة مضار الجوار غير المألوفة والمسئولية الناشئة عنها ضمن النظم القانونية السائدة في مصر وفرنسا وفلسطين والفقه الإسلامي، وتم إبراز الإيجابيات والسلبيات التي تضمنتها النظم القانونية محل الدراسة، حيث تم استقراء الحلول التي حملتها النصوص التشريعية، والمواقف القضائية والآراء الفقهية في تلك الدول في سبيل استنباط الحلول القضائية للحقائق القانونية الجزئية محل البحث وقد تناولت الدراسة بالشرح والتحليل نظرية مضار الجوار غير المألوفة حيث تم بيان موقف الفقه والقانون من نظرية مضار الجوار غير المألوفة ومضمون النظرية من حيث نشأتها والفكرة التي تقوم عليها وشروطها، ثم تناولت مفهوم فكرة الجوار والمضار غير المألوفة من خلال عرض مدلول الجوار من حيث الأموال والأشخاص، وتقدير الضرر غير المألوف وضوابط تقديره. ومن ثم تناولت الدراسة أساس المسئولية عن مضار الجوار غير المألوفة من خلال عرض أهم الاتجاهات التي تؤسس عليها النظرية، فتناولت الاتجاه الذي يقيم المسئولية على فكرة الخطأ والاتجاه الذي يقيمها على أساس موضوعي، ثم تناولت ذاتية المسئولية عن مضار الجوار غير المألوفة حيث تم بيان استقلال قواعد المسئولية عن مضار الجوار غير المألوفة عن قواعد المسئوليات الأخرى، ثم تناولت الأحكام الخاصة بالمسئولية عن مضار الجوار غير المألوفة من خلال عرض أحكام التعويض المستحق للمضرور، ومدي إمكانية دفع المسئولية بالسبب الأجنبي وبالترخيص الإداري، ثم تناولت الأحكام الخاصة بدعوى المسئولية عن مضار الجوار غير المألوفة من حيث تعدد المسئولين عن الضرر غير المألوف وتقادم دعوى المسئولية.<br/>وأخيراً تناولت الدراسة أهم تطبيقات نظرية مضار الجوار غير المألوفة من حيث الأضرار الناتجة عن تلوث الهواء والمياه والتربة، والضوضاء، وحجب الضوء والشمس والهواء. |

The study took the harm of unfamiliar neighboring and the responsibility arising from it within legal systems prevailing in Egypt, France, Palestine and Islamic jurisprudence.<br/>It was pointed out the positive and negative which included legal systems under study, it was extrapolated the solutions which legitimacy texts judicial situations and jurisprudence views carried in these counties in order to elicitation judicial solutions to the legal partial truths under discussion.<br/>The study addressed by explanation and analysis the theory of unfamiliar harm neighborhood and it was clarified the position of jurisprudence and law from this theory and the content of the theory from where its inception, the idea underlying and its conditions.<br/>After that, it addressed the concept of the idea of the neighboring and unfamiliar harmful through showing the meaning of neighborhood from where money, people and estimate the unfamiliar harm and its appreciation controls.<br/>Then the study took in the basis responsibility for the unfamiliar neighboring throw showing the most important ways which the thesis based on. The study addressed the way that evaluate the idea of fault and the way which evaluate it on an objective basis.<br/>Then addressed the self- responsibility for the harm caused by theunfamiliar neighborhood where it was declared the independent responsibility rules of the unfamiliar neighboring harm of other responsibilities.<br/>Then it addressed the private provisions of responsibility for the harm of the unfamiliar neighboring through showing the compensations rules to injured and possibility of push the responsibility for foreign reason and administrative license.<br/>After that it took the private provisions claiming the responsibility for the harm of unfamiliar neighboring from where the multiplicity of responsible for the unfamiliar harm and unusual claim of responsibility. Eventually, the study addressed the most important applications of the theory of harms of the neighborhood from where the damage caused by air, water, soil and noise pollution and covering light the sun and the air. |
