تتمثل أهمية الدراسة في أنها تناول موضوعا من أهم الموضوعات الخاصة بالملكية الفكرية ومرتبطة بالمشروع التجاري، وواجهت الدراسة ندرة في الكتابات المتخصصة وندرة في الأحكام القضائية وقسمت الدراسة إلى فصل تمهيدي خصص لدراسة وضع تعريف للاسم التجاري وظيفته<br/>والتفرقة بينة وبين الرموز المشابهة له.<br/>وتناول الباب الأول الحق في الاسم التجاري والسمة التجارية، وعني هذا الباب بدراسة تكوين الاسم التجاري سواء للتاجر الفرد الطبيعي أو الشخص المعنوي وكذلك اكتساب ملكية الاسم التجاري سواء بالاستعمال أو<br/>التسجيل ثم دراسة السمة التجارية والعنوان الالكتروني.<br/>وتناول الباب الثاني نطاق الحق في الاسم التجاري وحمايته خصائص الفصل الأول لدراسة طبيعة الاسم التجاري سواء المعنوية أو دراسة الاسم التجاري من حيث انه مال وقيمة والعقود الواردة عليه كذلك دراسة آثار اكتساب الحق علي الاسم التجاري وانقضاؤه والحماية القانونية للاسم<br/>التجاري سواء من الناحية الجنائية أو المدنية أو الدولية في فصل ثاني.<br/>وانتهت الدراسة بعد ذلك بخاتمة وبعض التوصيات التي يري الباحث<br/>أهميتها في هذا الموضوع. |

L'intérêt de ce sujet réside dans le fait, qu'il porte sur un des thèmes les plus importants du droit de la propriété intellectuelle tout en gardant une relation avec l'entreprise commerciale. L'étude a rencontré une certaine difficulté quant à la rareté des ouvrages et le manque de jurisprudence. Cette étude a été divisée de la manière suivante: Une partie introductive consacrée à la définition du nom commercial, sa fonction et sa comparaison avec d'autres termes semblables.<br/>La première partie s'est intéressé au droit du nom commercial ainsi que son caractère commercial. Cette partie s'attarde essentiellement à l'étude de la valeur du nom commercial tant pour le commerçant, personne physique, que pour la personne morale ainsi que les modes d'acquisition de la propriété du nom commercial, que ce soit par l'utilisation ou par l'inscription, avant d'aborder enfin le caractère commercial et l'adresse électronique.<br/>La deuxième partie, a soulevé la portée du droit du nom commercial ainsi que sa protection. On y trouve tout d'abord, une recherche quant à la nature du nom commercial, immatérielle d'un côté mais aussi matérielle, d'un autre, de sorte qu'il constitue une valeur, avec des contrats l'entourant. Enfin, une recherche est consacrée sur les effets de l'acquisition du droit au nom commercial et sa prescription, et la protection juridique de nom commercial, que ce soit sur le plan pénal, civil ou international.<br/>Dans la conclusion, le chercheur propose certaines recommandations qu'il considère comme importantes pour ce sujet. |
