| Summary, etc. | تناولت هذه الدراسة موضوع "إشكاليات تنفيذ أحكام التحكيم الأجنبية الصادرة في مجال الاستثمار في اليمن وبعض الدول العربية والأجنبية" وهي دراسة قانونية مقارنة بين قانون التحكيم اليمني رقم (22) لسنة 1992م، وقانون التحكيم المصري رقم (27) لسنة 1994م، مع بعض التشريعات العربية والأجنبية، حيث بدأت ببيان مدلول الاستثمار والمستثمر وماهية منازعات الاستثمار وأنواعها وطرق تسويتها، وأوضحت أن نظام التحكيم والمركز الدولي (اى سى اس اى دى) المنشئ بموجب اتفاقية واشنطن لسنة 1965م، هما أنسب الوسائل وافضلها لتسوية منازعات الاستثمار، وان اتفاقية نيويورك لسنة 1958م، هي أفضل المعاهدات والاتفاقيات الدولية لتنفيذ أحكام التحكيم الأجنبية برغم ما فيها من قصور وتناقض في نصوصها، وخلصت إلى ان إشكاليات تنفيذ أحكام التحكيم الأجنبية ترجع إلى عدة أسباب. وقد اختتمت هذه الدراسة بعرض أهم النتائج والتوصيات التي توصلت إليها |

| Summary, etc. | This study has dealt the subject of "Problems of carrying out the rulings of the Foreign Arbitration issued in the field of investment in Yemen and some Arab And Foreign countries" and it is a comparative legal study among Yemeni Arbitration Law No. (22) for the year 1992 A.D and Egyptian Arbitration Law No. (27) for the year 1994 A.D with some Arab and Foreign legislations, where I started with showing signification of investment and investor and essence of investment disputes (conflicts), its types and techniques of its settlement, and I clarified that the arbitration system and the International Center (ICSID) established according to Washington Convention for the year 1965 A.D are the most appropriate and best techniques for settlement of investment disputes and New York Convention for the year 1958 A.D is the best international treaties and conventions to carry out the rulings of foreign arbitration despite what it has from inability and contradiction in its texts and I concluded that problems of carrying out the rulings of arbitration are due to several reasons.<br/>And I concluded this study by showing the most important<br/>results and recommendations that I reached by. |
