| Summary, etc. | إن موضوع الدراسة هو مبدأ المواجهة في القانون الإماراتي في الإجراءات الإدارية القضائية : وأتّبع الباحث المنهج التحليلي والمنهج التطبيقي والمنهج المقارن. وتمّ تقسيم الدراسة إلى أربعة فصول الفصل التمهيدي : الضمانات التأديبية للموظف العام: والفصل الأول: نشأة مبدأ المواجهة وتعريف نطاقه وتطبيقه في الإجراءات الإدارية القضائية: والفصل الثاني: ضمانات تطبيق مبدأ المواجهة في الإجراءات الإدارية القضائية وعلاقته بمبادئ الإجرائية الأخرى : و الفصل الثالث: أهمية التزام القاضي بمبدأ المواجهة وحمل الخصوم على الالتزام به. وتوصل الباحث إلى عدد من التوصيات منها : إنشاء نظام قانوني و قضاء إداري مستقل: وذلك لتعزيز فكرة التخصص القضائي : وأيضًا سرعة الفصل في المنازعات الإدارية القضائية والتسارع في إجراءاتها وضمان تطبيق مبدأ المواجهة في جميع مراحل الدعوى الإدارية : وكذلك التأكيد على الضمانات التأديبية: وذلك من خلال تأهيل أعضاء لجان التأديب ، وتثقيف الموظفين بحقوقهم القانونية. |
