| Summary, etc. | انتهينا - بعون من الله وتوفيقه - من هذا البحث المتواضع والذى استعرضنا فيه أحكام عقود البناء والتشغيل: ونقل الملكية الـ النظرية التقليدية للعقود البوت الإدارية التى ابتدعها الفقه والقضاء الفرنسى: وأخذ بها الفقه والقضاء المصرى وساهم فى تطويرها بشكل كبيرخاصة أحكام عقود التزام المرافق العامة: على اعتبار أن عقود الـ بوت من أشد العقود الإدارية شبها بها: بل إننا نستطيع القول إنها قد ظهرت إلى النور من رحم عقود الالتزام: الأمر الذى دعى البعض للقول بإنها مجرد امتداد لها وصورة جديدة لها. ولقد تناولنا فى التمهيد بشىء من الإيجاز ماهية عقود الـ بوت: وصورها المتعددة: وأوضحنا مزاياها وعيوبها بالنسبة لطرفى العقد كليهما. ثم تناولنا الطبيعة القانونية لهذه العقود وبينَّا الإطار الدستورى والتشريعى الحاكم لها. |

| Summary, etc. | We've completed, with God's help and prosperity, this humble research, in which we've reviewed the terms of building, Operation& Property Transfer "B.O.T." Contracts in Yemen "Comparative Study"<br/>In the light of the terms of the conventional theory for Administrative Contracts, that had been created by the French jurisprudence and judiciary, and the Egyptian jurisprudence and judiciary have taken with, and contributed in its development to a large deal, specially, the Public Utility commitment contract provisions, considering that "B.O.T." contracts are of the most similar administrative contracts thereof, moreover, we may say that it has emerged to existence from the womb of commitment contracts, which had made some to say that it is just an extension and a new Image thereof |
