| Summary, etc. | تقوم الدولة الحديثة على مبدأ المشروعية و مقتضاه أن تخضع الدولة فى تصرفاتها للقانون . و لا يكفي لتكامل دولة القانون أن يكون اللجوء إلى القضاء متاحا مكفولا : و انما لابد من اكتمال منظومة العدالة بأن تكفل الدولة و تضمن تنفيذ الاحكام التي ينتهي بها مطاف الخصومات . و قد ثبت من الواقع أن المماطلة و الامتناع عن تنفيذ الاحكام القضائية الصادرة في الدعاوي الادارية ضد الدولة و تأخير تنفيذها على درجة من الخطورة لما في ذلك من زعزعة للثقة في الدولة كدولة قانون : و يوصمها بعدم التحضر و مساس بوجه العدالة و امتهان لسلطة القضاء |

| Summary, etc. | The modern State stands on the principle of "Legality" that means the need to undergo the State in its actions to Law. It is not enough, to allow and guarantee the right to litigate; for the integration of the State of Law, but the State must complete the justice system to ensure and guarantee the implementation of the provisions which ends the adversarial.<br/>It is proved the fact that procrastination and refrain from implementing court rulings, issued in administrative proceedings against the State and the delay of their implementation, represents a degree of risk, because of the undermining of confidence in the State, as a State of Law, and stigmatization of the State as uncivilized State, and prejudice to the justice and preying to the authority of the judiciary.<br/>After growing problem of abstention of Management in implementation of administrative rulings issued against it, owing to its adherence to the rule of "the inadmissibility of forced execution" against it, the Management created modern ways and guarantees to confront this phenomenon, especially after the merits of provisions included complaints from the might of administration and its tendency towards the non-implementation (explicitly or implicitly).<br/>After the Jurisprudence's researches had shed light on this dilemma, the French Legislator rushed to intervene and enact modern safeguards in order to coercion and force management to respect authoritative and implementation of the provisions in reasonable periods.<br/>As the judiciary in France has founded solutions for the administration's abstention to implement administrative provisions, the Legislature and the Administrative Judge in both Egypt and Kuwait are invited to follow the modern theories of Jurisprudence and Judicial, and to introduce and apply them to consolidate the values of justice and equity |
