| Summary, etc. | في إطار السعي وراء الأهداف الوقائية نجد التشريعات المتباينة استهدفت بالتجريم سلوكيات في مراحل مبكرة تفاديًا لما قد تحدثه من مخاطر مستقبلية، ومن ثم تمديد المسؤلية الجنائية إلى ما قبل الشروع، ونقل القانون الجنائي من التفاعل مع آثار الجريمة إلى التناغم مع مقدماتها، وهو تحول من مجتمع " ما بعد الجريمة " إلى مجتمع " ما قبل الجريمة " والأخير ما هو إلا إمتداد عقابي لسلوك سابق على تحقيق الضرر الفعلي، وهدفه إقامة حصن حول مصالحمجتمعية رأى المشرع جدارتها بالحماية، وهي سياسة استباقية سعت الدول المتباينة من خلالها إلى تجريم الأعمال التحضيرية للجرائم بنصوص خاصه ومستقله، وهو تجريم تحوطي سباق يستهدف سلوك سابق على الشروع، وهو إمتداد عقابي أحدث زيادة كمية ونوعيه في تلك الجرائم، مما استوجب وضع ضوابط يلزم الأخذ بها حيال الخوض في ذلك التجريم. |

| Summary, etc. | In the context of pursuing preventive goals, we find that the different legislations targeted criminalization with behaviors in the early stages in order to avoid the future risks that they may cause, and thus extending criminal responsibility to before the attempt, and transfering criminal law from interacting with the effects of the crime to harmony with its preliminaries, which is a shift from a "post-crime" society to a "pre-crime" society, and the latter is nothing but a punitive extension of behavior prior to the actual harm, and its goal is to establish a fortress around societal interests that the legislator saw as worthy of protection, and it is a proactive policy through which the different countries sought to drag the preparatory work for crimes with special and independent texts, and it is a precautionary, proactive criminalization targeting behavior prior to the attempt, and it is a punitive extension that caused a quantitative and qualitative increase in those crimes, which necessitated the establishment of controls that must be taken into account when engaging in that criminalization |
