إذا كانت الأمم تحيا بأخلاقها ، وتخلد حضارتها بسمو العدل فيها ، فإنه بقدر ما يمتد سيف العدالة فيها ظلا وحماية للمحاكم والمحكوم ، بقدر ما ينحسر الظلم ، فتبقى دائما كلمة الحق في العليا. والقضاء هو سبيل ذلك ، فإلى ساحته يهرع الناس جميعاً ، يلتمسون فيه العدل والنصفة ، وهم عنده سواء ، فهو حصن الأمان لكل من داهمه الخوف ، وهو سيف الحق يبتر كل يد تمتد إلى حرمات الناس لتهدر دماءهم أو تهتك أعراضهم أو تستبيح مالهم أو توهن من عزائمهم في اتباع المعروف أو نهى عن منكر.<br/>ومما لا شك فيه أن القضاء الذي يملك القدرة على تحقيق ما تقدم وإقرار العدل المنشود بتطبيق القانون على الكافة ، هو القضاء الذي تتوافر فيه وله مقومات وضمانات الحيدة والنزاهة والاستقلال.<br/>ومن هذا المنطلق يظل الحديث عن القضاء وطبيعته قائماً ومستمراً نظراً لما دأب عليه المشرع في العديد من التشريعات من إنشاء العديد من المحاكم أو الكيانات الاستثنائية أو الخاصة وتخويلها سلطة الفصل في نوعيات معينة من القضايا أو المنازعات<br/>وجدير بالذكر أن تلك النوعية من المحاكم الخاصة تختص بمحاكمة أنواع من المجرمين ، يتميز أفراد كل نوع منها بخصائص اجرامية معينة ، من حيث عوامل اجرامهم ومقتضيات المعاملة العقابية الملائمة لهم ، مما يقتضى بالضرورة تميز اجراءات محاكمتهم بقواعد خاصة. ومما لا شك فيه أن هذا النوع من القضاء الخاص يتفق مع تعاليم السياسة الجنائية الحديثة ، باعتبارها تستهدف الملاءمة بين تشكيل القضاء وإجراءات المحاكمة من ناحية ، وبين اتصاف عوامل هذه الاجرام لدى فئات من المجرمين بخصائص معينة ، واقتضاء مواجهة هذه العوامل بعقوبات وتدابير من نوع معين |

If nations live by their morals, and their civilizations are immortalized by the sublimity of their justice, then to the extent that the sword of justice extends its shadow and protection to the courts and the governed, injustice will recede, and the word of truth will always prevail. The judiciary is the path to this. All people flock to its court, seeking justice and fairness, and they are equal before it. It is a fortress of safety for all who are overcome by fear. It is the sword of truth that cuts off every hand that reaches out to violate people's sanctities, to shed their blood, violate their honor, seize their wealth, or weaken their resolve to follow what is right or forbid what is wrong.<br/>There is no doubt that the judiciary that possesses the ability to achieve the above and establish the desired justice by applying the law to all is the judiciary that possesses and possesses the elements and guarantees of impartiality, integrity, and independence. From this perspective, the discussion of the judiciary and its nature remains ongoing, given the legislator's practice in many pieces of legislation of establishing numerous exceptional or special courts or entities, granting them the authority to adjudicate specific types of cases or disputes.<br/>It is worth noting that these special courts specialize in trying different types of criminals, each of whom is characterized by specific criminal characteristics, in terms of the factors that contribute to their criminality and the requirements for appropriate punitive treatment.<br/>This necessarily requires that their trial procedures be characterized by special rules. Undoubtedly, this type of special judiciary is consistent with the teachings of modern criminal policy, as it aims to achieve harmony between the formation of the judiciary and trial procedures, on the one hand, and the characteristics of certain criminals, on the other hand, and the need to address these factors with specific types of penalties and measures |
