تعد الخلفية اللازمة للرقابة القضائية على دستورية التشريعات النظم الديمقراطية سواء في تنظيمها أو في آليات ممارستها؛ ذلك أن النظم الديمقراطية الحقيقية تتسم حكوماتها بدعم الجماهير لها، وبالتنافس بين أحزابها السياسية، وبتداول السلطة، بما مفاده أنه لا ضمان لجهة الرقابة القضائية على الدستورية في القيام بوظائفها بصورة جادة إلا في الأنظمة التي توافق الأنظمة الديمقراطية في ركائزها وصحيح بنيانها، واعتبار الناس جميعهم سواسية في الحقوق كافة.<br/>وتعبر الرقابة الدستورية عن مبدأ الدستورية باعتباره الملازم الطبيعي والفعال لسمو الدستور ومبادئه، والتي اعتادت الدول منذ القرن الثامن عشر على أن يكون لديها دستور مكتوب جامد له قيمة قانونية تفوق قيمة القواعد القانونية الأدنى منه؛ ومن ثم اعتلى مبدأ الدستورية والذي يحققه القضاء الدستوري تأسيسا على أنه يعلي قواعد الدستور ومبادئه أسوة بمبدأ المشروعية، والذي يرتبط تاريخيا في النظام الدستوري الفرنسي بسمو القانون العادي.<br/>وحيث إن الجمود الدستوري الذي يقوم في جوهره على الإجراءات الخاصة التي تعدل بها القاعدة الدستورية هو أساس وضع الدستور في مرتبة أعلى من التشريعات البرلمانية، مما يتعين عدم خروج هذه التشريعات عن أحكامه، فإن الأمر يقتضي تنظيم رقابة الدستورية، تلك الرقابة التي تتأرجح في حلولها بين الرقابة السياسية والرقابة القضائية، ومع أهمية الأخذ بأسلوب الرقابة المركزية في أسلوب مباشرتها |

The necessary background for judicial oversight of the constitutionality of legislation is democratic systems, both in their organization and in the mechanisms of their implementation. True democratic systems are characterized by governments supported by the masses, competition between political parties, and the rotation of power. This means that judicial oversight of constitutionality can only be guaranteed to perform its functions effectively in systems that conform to democratic systems in their foundations and sound structure, and that consider all people equal in all rights.<br/>Constitutional oversight expresses the "principle of constitutionality," as it is the natural and effective concomitant of the supremacy of the constitution and its principles. Since the eighteenth century, states have been accustomed to having a rigid written constitution, with a legal value superior to that of lower legal rules. Thus, the principle of constitutionality, achieved by the constitutional judiciary, is elevated, based on the principle that it elevates the rules and principles of the constitution, similar to the principle of legality, which is historically linked in the French constitutional system to the supremacy of ordinary law. Since constitutional stagnation, which is essentially based on special procedures for amending constitutional rules, is the basis for placing the constitution above parliamentary legislation, which requires that such legislation not deviate from its provisions, it is necessary to regulate constitutional oversight. This oversight oscillates between political and judicial oversight, while emphasizing the importance of adopting a centralized approach to its implementation. |
