| Summary, etc. | تمثل موضوع البحث في دراسة حجية أحكام المحكمين وآثارها من خلال دراسة مقومات حكم التحكيم التي تعددت بشأنها آراء الفقهاء بحيث أنعكس هذا التعدد على موقف القانون والقضاء وهذه المقومات هي الطبيعة القانونية لحكم التحكيم الفاصل في النزاع والصادر عن هيئة التحكيم أساس حيازته للحجية.<br/>ففكرة الحجية تقوم على أن ما سبق عرضه على القضاء وتم الفصل فيه لا يجوز أن يطرح للنقاش مرة أخرى أمام نفس المحكمة التي أصدرت الحكم، وأمام أي محكمة أخرى ليفصل فيها من جديد.<br/>فالرأي الغالب يذهب إلى ثبوت الحجية لأحكام التحكيم من صدورها وتبدأ حيازة الحكم للحجية الشيء المقضي بمجرد كتابة الحكم والتوقيع عليه.<br/>وما ترتبه الحجية من آثار تنعكس على الحكم التحكيمي من حيث جواز الطعن بالبطلان في الحكم التحكيمي ومن حيث عقبات تنفيذ الحكم الحائز على الحجية وذلك بعد صدور أمر التنفيذ من القاضي المختص. |
