| Summary, etc. | عند نشوء القوانين الجزائية لم يكن نظام رد الاعتبار معرف عند أغلب المشرعين، لكن نتيجة لتطور السياسة العقابية الحديثة والتى أصبحت تهدف لإصلاح وتأهيل المحكوم عليهم أصبح لهذا النظام وزن كثير وأهمية بالغة إذ أن العقوبة يجب أن تسلط على المحكوم عليه بقدر ما ارتكب من جرم وأن تنتهى أثارها بانقضاء العقوبة، أنه لمن الظلم بما كان أن تبقى السابقة القضائية وصمة عار تلاحق المحكوم عليه حيثما حل وارتحل وتصبح حجرة عثر فى طريق إصلاحه وتأهيله، إن جل التشريعات تطرقت إلى نظام رد الاعتبار بنوعية إذ حددت شروطية وإجراءاته ولم يكن بينها إلا بعض الاختلافات البسيطة.<br/>وهذا البحث تطرقنا فيه لتعريف نظام رد الاعتبار مع بيان أغراضه وتميزه عن غيره من الأنظمة المشابهة، كما تطرقنا لشروط وإجراءات كل من رد الاعتبار القانوني والقضائي، وأخيرا فإن هذا النظام يفتح الطريق للمحكوم عليه الذي نفذت عليه العقوبة كي ينخرط في المجتمع مرة أخرى وحتى لا يبقى ماضيه الإجرامي حجرة عثر أمام عودته إلى حياة اجتماعية طبيعية. |

| Summary, etc. | On the emergence of the punitive laws, is known to almost of the legislators. However, as a result of the development of the modern punitive policy which aims at rehabilitation and restitution of the convicted, thus, this statute had its weight and significant importance.<br/>As the punishment must be directed to the convicted as much as the crime he committed and its effects shall end with the termination of the punishment.<br/>Its was unjust for the judicial precedent to be a stigma chasing the convicted wherever he goes and it becomes an obstacle in the way of rehabilitation and restitution.<br/>Little legislation dealt with the statute of Restitution with its two kinds, since it determined its conditions and procedures. But it only includes some slight differences.<br/>We dealt in this research with the statute of Restitution along with illustrating its purposes and distinguishing it from other similar statutes we also dealt with the conditions and procedures of legal and judicial restitution.<br/>finally this statute opens a room for the convicted who was sentenced to involve in the society again and in order to have his criminal past an obstacle before his return to natural social life. |
