This study examined subject of payment with subrogation through the statement of what it is, and a statement of cases of legal subrogation received under the general text, either cases where the payer is obligated by debt with the debtor, or in cases where the payer is obligated to pay instead of the debtor, or subrogation of the late ranked creditor to subrogate the creditor preceded him, or subrogation of buyer mortgaged property who assigned the property to ensure their rights. and also statement agreeable subrogation, both by agreement in with the creditor or with the debtor, and the role of subrogation in support of the credit. and also this has been handling cases of legal subrogation which received special texts, both legal subrogation of the insurance company, or subrogation of the payer through intervene to replace the holder, or reserve guarantor subrogation, or Social Insurance Authority subrogation, or subrogation landlord and subtenant in place of original tenant on returning each one of them back on other in the Jordanian law. Then clarified effects of payment with subrogation, both in terms of the scope of impact carrier to payment with subrogation, and through subrogation of the payer in place of the creditor in the right with its characteristics and sequences, and assigned to insurance, with its characteristics and sequences. or restrictions contained on payer subrogating creditor, through restrictions based on the position of subrogation parties and partial payment of debt, and a creditor commitment that the payer will return on debtor.<br/>This thesis has shown that the Jordanian civil law did not address the issue of payment with subrogation as a general theory unlike to the Egyptian law and the laws in other Arab countries, but this did not stop law from taking some applications, it came in special texts and for meeting the, other hand this thesis reached to a group of recommendations, including; need to organize Jordanian legislator for payment with subrogation within the general rules in order to open the door to meet in the form of a general theory, and the need to reformulate some texts of articles to remove the ambiguities and uncertainties with respect to certain topics and other recommendations have been referred to in the conclusion of this thesis. |
