الغرض من موضوع هذا البحث هو ايجاد جهة محايدة يسند اليها الاختصاص بالفصل فى صحة العضوية النيابية : ففى النظم المقارنة نجد ان بعض الدول كانت تسند هذه المهمة الى البرلمان : ثم عدلت عن ذلك وعهدت بهذا الاختصاص الى القضاء العادي : ونموذج ذلك المملكة المتحدة : وأيضا دولة الكويت والتى عهدت به الى القضاء الدستوري |
