| Summary, etc. | ويواجه هذا المجال القانوني تحديات عديدة ترتبط بتطور وتنوع مصادر القانون الدولي للاستثمار، وتوافق وتناسق القواعد والمبادئ القانونية المطبقة على هذه المنازعات وبدور ومكانة السوابق من الأحكام في تفسير وتطبيق هذه القواعد. فمن جهة، يتسم القانون الدولي للاستثمار بالتشتت والتفاوت بين مختلف الاتفاقيات والعقود والممارسات الدولية المنظمة له، ومن جهة أخرى، يتسم التحكيم الدولي في منازعات الاستثمار بالتعدد والتنافس بين مختلف قواعد مراكز ومؤسسات وهيئات التحكيم المختصة بهذا النوع من المنازعات، وهو ما كان له من أثر في ظهور مشاكل التناقض والتباين بين الأحكام التحكيمية التي تصدر فيها. |
