| Summary, etc. | استعراض أهم جوانب مفهومي المنافسة و الاحتكار غير المشروعين في القانونين الكويتي و المصري و مقارنتهما - بقدر الإمكان - مع قوانين الدول المتقدمة في هذا المجال و ذلك للخروج بعدة توصيات و نتائج تتحصل في ضرورة إفراد قوانين اقتصادية لمكافحة الظاهرة محل الدراسة و جعل محاكم خاصة بغية تطبيق تلك القوانين عليها من قبل قضاة متخصصين. يمثل القانون بيئة تشريعية مهمة لضبط النشاط الاقتصادي: و هو ما يدعونا إلى الاستمرار في دراسة تجارب الدول التي لها خبرة في صدور قوانين منع الاحتكار بحيث يمكن إضافة مواد جديدة تتناسب مع التغيرات التى تجرى على الساحة الاقتصادية؛ حيث إن الاحتكار يكون - دائما - في غير صالح المستهلك بعكس المستهلك بعكس المنافسة التي تعمل على توفير السلع الجيدة بالأسعار المناسبة |

| Summary, etc. | In partial fulfillment of the PhD of Commercial Law<br/>This study reviews the main sides of the concept of monopoly and illegal competition at the end of which the researcher concludes a set of recommendations concerning the damaging effect of the monopolistic practices, including:<br/>1- Necessity to look for the purpose of monopoly for the defendant to expand the base of conviction and protect the market against the harmful acts.<br/>2- Certain cases shall not be mentioned, including, but not limited to, being harmful to competition or including abuse of the monopolistic position, to achieve the first above mentioned objective. |
