إن أثر انتشار الأمراض المعدية لا يقف عند صحة المريض وحياته فحسب، وإنما يمتد ليفتك باقتصاد الدول ونظامها العام، ولقد ظلت المجتمعات تعاني من تزايد انتشار الأمراض المعدية. وتتعد أسباب هذه الأمراض فكما قد يكون السبب الرئيسي لعدد منها بثها بيولوجيا من دول أخرى، يكون في بعض منها غير ذلك، ولكن وإن كان الأول هو السبب لعدد منها، فإنه عندما يصل المرض المعدي للدولة يقع على عاتق الجميع منع انتشاره عمداً أو إهمالا للحفاظ على الصحة العامة. <br/>فكما يستبان من أنه قد تكون جريمة نقل المرض المعدي جريمة دولية، بيد أن ما يفاقم انتشار المرض المعدي بداخل الدولة الجريمة الوطنية بأن يتعمد المصاب نقل المرض لغيره أو يهمل في ذلك، أو يمتنع الطبيب عن علاج المريض، أولا يتم الإبلاغ عن المصاب، أو لا يتم الالتزام بالإجراءات التي تفرضها الدولة لمنع انتشار المرض المعدي أو غيرها من الصور التي تؤدي لانتشار المرض المعدي والتي لا تقتصر على الشخص الطبيعي وإنما تبدر من الشخص المعنوي أيضاً. <br/>لذا ناقشت هذه الرسالة مدى كفاية التنظيم التشريعي لهذه الجريمة في التشريعين المصري والعماني وذلك بتحليل ما ورد فيهما والمقارنة بينهما بصفة أساسية، وبصفة احتياطية بينهما وتشريعات دول الخليج. |

The impact of the spread of infectious diseases is not limited to the patient's health, but extends to the economy and public order of countries. Societies have been suffering from the spread of infectious diseases, and the causes of these diseases are numerous. While the main cause may be biological transmission from other countries, there are other causes as well. Regardless of the causes, when an infectious disease affects a country, it would be the responsibility of everyone to prevent its spread whether intentionally or negligently in order to preserve public health. Therefore, the crime of transmitting an infectious disease may be an international crime, but what aggravates the spread of an infectious disease within the country is another crime like the infected person deliberately transmitting the disease to others or neglecting to do so, or the doctor refusing to treat a patient, or not reporting the infected person to the relevant authorities, or not complying with the measures imposed by the country to prevent the spread of an infectious disease, or other actions that lead to the spread of an infectious disease that are not limited to the natural person but may also be done by the juristic person. Consequently, this thesis discussed the adequacy of the laws and regulations of this crime in the Egyptian and Omani legislations by analyzing and comparing them primarily and secondarily comparing between these two legislations and the legislations of the GCC countries. The thesis examined the way of defining an infectious disease in the Egyptian and Omani legislations, the legality of defining an infectious disease by the Minister of Health, the extent to which the crime of transmitting an infectious disease is considered a terrorist crime and its relationship to the crime of refusing to assist, and then addressed the intentional and unintentional crimes of transmitting infectious diseases in the Egyptian and Omani legislations.
