على الرغم من أن القانون الجنائي، يتسم بالتقليدية المفرطة، إلا أن القائمين على التشريع في الدول المختلفة، وجدوا أنه من المهم، أن يواكب القانون الجنائي، هذا التطور العلمي، ليس فقط في شقه الموضوعي المتعلق بالجرائم والعقوبات، وإنما - أيضًا- في شقه الإجرائي، المتمثل في الإجراءات الجنائية، بحيث اتجهت القواعد الموضوعية إلى صور تجريم جديدة تهدف إلى حماية القيم الأساسية التي ينهض عليها بنيان المجتمع، والتي أضحت مهددة بسبب التقدم التكنولوجي الحديث، ولم تعد القواعد التقليدية القائمة غير قادرة على كفالة هذه الحماية، خاصة في مجال حماية الحق في الخصوصية. وفي ذات السياق، كان اتجاه الجانب الإجرائي من القانون الجنائي، أى قانون الإجراءات الجنائية، إذ لم يشأ أن بيتعد عن التطور التكنولوجي، ووجد نفسه ملزما بمواكبة هذا التطور، خاصة تحت ضغط الظواهر الإجرامية الخطيرة، وأخصها الجرائم الإرهابية، وما تستلزمه من ضرورة الخروج، من رداء التقليدية المعروفة، وضرورة تبني مفاهيم جديدة للمقصود بمسرح الجريمة، وأدلة الإثبات، ونطاق المحاكمة الجنائية، والمبادئ الخاصة بالحضور والمواجهة في الإجراءات الجنائية:بحيث لم يعد لازما اجتماع المتهم والمحكمة في غرفة المحكمة، بل أصبح من اللازم فهم نطاق المحكمة، إلى ما يجاوز جدرانها. Although criminal law is characterized by excessive
traditionalism, those in charge of legislation in different countries
have found it important that criminal law keep pace with this scientific
development, not only in the substantive part related to crimes and
penalties, but also in the procedural part., which is represented in
criminal procedures, so that substantive rules tended to new forms of
criminalization aimed at protecting the basic values upon which the
structure of society stands, which have become threatened due to
modern technological progress, and the existing traditional rules are
no longer able to guarantee this protection, especially in the field of
protection of the right in privacy.
In the same context, the direction of the procedural side of the
criminal law, that is, the Criminal Procedure Law, was as it did not
want to deviate from the technological development, and found itself
obligated to keep pace with this development, especially under the
pressure of serious criminal phenomena, especially terrorist crimes,
and the entailed necessity of exit, From the well-known traditional
dress, and the necessity of adopting new concepts of what is meant by
the crime scene, the evidence of proof, the scope of the criminal trial,
and the principles of attendance and confrontation in criminal
procedures: so that it is no longer necessary for the accused and the
court to meet in the court room, but rather it has become necessary to
understand the scope of the court, to what goes beyond its walls.
