تناولت فى هذه الرسالة جانبين على الوجه التالى: الجانب الأول: "النظام القانونى الذى يحكم المسئولية المدنية للمحامى تجاه عملائه فى نظام المحاماة السعودى و قانون المحاما المصرى" حيث نتعرض لمفهوم المحاماة أو الوكالة بالخصومة: و قواعد أخلاقياتها: و الطبيعة القانونية للعقد بين المحامى و العميل: و الالتزامات الواقعة عليهما: فمن جانب المحامى تقديم المشورة و منع وقوع الضرر بعميله: و عدم إفشاء سر المهنة: كما يقع على العميل التزام بدفع الأتعاب المستحقة. الجانب الثانى: "أحكام المسئولية المدنية للمحامى": و الذى نستعرض فيه أركان المسئولية المدنية للمحامى: نحاول فيه توضيح مفهوم خطأ المحامى و معياره و صوره و تطبيقاته المختلفة: و شروط الضرر الناجم عن الخطأ: و تكييف الفرصة الضائعة على العميل: و حالات سقوط مسئولية المحامى: و نتعرض لجزاء المسئولية المدنية للمحامى: و مدى إمكانية التنفيذ العينى الجبرى لأعمال المحاماة: و تقدير المحكمة للتعويض عن الضرر بنوعيه: و فى الأخير التأمين على المسئولية المدنية للمحامى و مدى فاعلية هذا التأمين. شملت الدراسة بعض أحكام المحاكم الفرنسية وم حكمة النقض فى مصر و فرنسا فيما يخص المسائل التى تناولتها الدراسة: و كان أهم النتائج: خلو نظام المحاماة السعودى و قانون المحاماة المصرى من النص على المسئولية المدنية للمحامى: و أهم التوصيات: وجوب النص على الحالات التى يمكن أن يسأل فيها المحامى على أساس عقدى و الحالات التى يسأل فيها على أساس تقصيرى In this letter, I dealt with two aspects as follows:-
* - The first aspect: "The legal system that governs the civil liability of the lawyer towards his clients in the Saudi legal system and the Egyptian law" where we discuss the concept of lawyering or agency by litigation, its rules of ethics, the legal nature of the contract between the lawyer and the client, and the obligations on them, on the part of the lawyer to provide advice Preventing harm to his client, not disclosing the profession's secret, and the client has an obligation to pay the fees due
* - The second aspect: "Provisions of the civil liability of the lawyer", in which we review the pillars of the lawyer's civil liability, in which we try to clarify the concept of the lawyer's error, its standard, its forms and its various applications, the conditions for damage caused by the error, adapting the lost opportunity to the client, cases of fall of the lawyer's responsibility, and we are subject to a penalty The civil liability of the lawyer, the extent of the possibility of compulsory in- kind execution of the work of the lawyer, and the court's assessment of compensation for both types of damage, and finally, insurance on the lawyer's civil liability and the extent of the effectiveness of this insurance.
The study included some rulings of the French courts and the Court of Cassation in Egypt and France with regard to the issues dealt with in the study, and the most important results were: The Saudi legal system and the Egyptian legal profession are free from stipulating the civil liability of the lawyer, and the most important recommendations: The necessity of providing for the cases in which the lawyer can be asked about The basis of my contract and the cases in which he is asked on the basis of negligence.
