تعد فكرة نظام محكم الطوارئ من أهم الابتكارات الرئيسة الواردة في غالبية القواعد المنقحة في مختلف مؤسسات ومراكز وغرف التحكيم الدولية، حيث إن أحكامه تمنح أطراف التحكيم إمكانية الحصول على الحماية الوقتية قبل تشكيل هيئة التحكيم أي عند توافر إحدى الحالات
الطارئة وبالسرعة والخبرة والكفاءة اللازمة.
لذلك يعد اعتماد مؤسسات ومراكز التحكيم الدولية على نظام محكم الطوارئ حلاً فعالاً ومثالياً، حيث يملأ الفجوة التي قد تهوي فيها حقوق أطراف منازعة التحكيم، ويستجيب للحاجة إلى اتخاذ تدابير طارئة قبل تشكيل هيئة التحكيم دون اللجوء إلى قضاء الدولة الذي قد يستغرق وقتاً طويلا، وذلك لا يتوافق مع حاجة أطراف منازعة التحكيم المتمثلة في الحفاظ على سرية المعلومات التي تخص أعمالهم، والسرعة التي يسعى
إلى تحقيقها أطراف التحكيم.
