تهدف هذه الدراسة إلى التعرف على عيب مخالفة القانون كأحد أوجه عدم صحة القرارات الإدارية في القضاء الإداري العماني والمصري وذلك وفقاً للتعديل الأخير لقانون محكمة القضاء الإداري الصادر بالمرسوم السلطاني رقم 3/2009: والمبادئ التي استقر عليها القضاء الإداري العماني والمصري والفرنسي. وذلك لتأثير هذا الوجه على مشروعية القرار الإداري. مما يوجب بسط الرقابة القضائية علية عندما يثور أي طعن في عدم مشروعية القرار. من هنا انطلق الدور الإيجابي للقاضي الإداري للتحقق من أدلة الإثبات على أساس ظروف القانون الإداري وطبيعة الدعوى الإدارية التي يختص بنظرها : مع ابراز حجية الأحكام القضائية وتنفيذها This study aims to recognize the defects of contraventing the law as one of the aspects of the disqualification of the administrative decisions in the Egyptian and Omani administrative judiciary according to the last amendment that was done by the administrative judiciary court and issued by the Royal decree 3/2009. In addition to the principles of the Omani, Egyptian and French administrative judiciary. However, this aspect afflicts the legality of the administrative decisions.
So, the judiciary oversight should have control on it when there is any kind of appeal against the legality of the decision from that point, the positive role of the administrative judge is quite clear to ensure and protects the evidences according to the circumistances of the administrative law and the nature of the administrative proceedings which are tied with administrative relations where administration is a part in this.with highlight authoritative judicial decisions and implementation.
