تمثل الرقابة القضائية فى الواقع و القانون أقوى الضمانات المعاصرة لإقرار مبدآ المشروعية: و لصيانة حقوق الأفراد و حرياتهم ضد عبث الإدارة و تعسفها: و لذلك تضمن الدستور الكويتى نصآ صريحآ بشأن تنظم الرقابة القضائية على أعمال الإدارة ؛ حيث نصت المادة 169 من الدستور الكويتى على أن ينظم القانون الفصل فى الخصومات الإدارية بواسطة غرفة أو محكمة خاصة يبين القانون نظامها و كيفية ممارستها للقضاء الإدارى شاملآ ولاية الإلغاء و ولاية التعويض بالنسبة إلى القرارات الإدارية المخالفة للقانون Judicial control is the stronger guarantees in recent time to achieve the principle of legality, to maintain the Individual rights, against administration's arbitrariness. For this reason, we find the Constitution of Kuwait includes a text around this subject. The text of article No 169 in Constitution of Kuwait says, "Administrative decisions, or the Court decisions must be consistent with the view of law. This includes the Court's ability to issue its decisions by dismissal or cancellation. or compensation in respect of administrative decisions contrary to the law".
We know that the Judicial control may be occur through the normal judicial, or occur through judicial control. No way before aggrieved just demand his right through lawsuit against the public official in his personal capacity, in the court the aggrieved is surprised, that the public official is cant be give him his right, and his right lost by this way.
The state turned from the guard state to intervening state in all area of life like economic activity, or social activity. Many foundations were built according to the activity of the state.
