المعارضة طريق طعن عادي: يقع على الأحكام الغيابية و الحضورية الاعتبارية بشروط: ميعادها ثلاثة أيام في التشريع الليبي: و عشرة أيام في التشريع المصري: و هذا الميعاد قد يمتد لأي سبب من أسباب الامتداد القانونية: و المعارضة مقررة لمصلحة المحكوم عليه غيابيآ و المسئول عن الحقوق المدنية: و إجراءاتها مبسطة: يتم التقرير بها أمام الكاتب المختص بالمحكمة التي أصدرت الحكم الغيابي: و هذا التقرير يعتبر إعلانا لها و لو كان التقرير من وكيل فى التشريع المصري Opposition is an ordinary way of appeal, and it is applied to the
judgments in absentia and attending judgments on conditions, its date is three
days in the Libyan legislation and ten days in the Egyptian legislation, and this
date may be extended for any legal reason, and the opposition is decided for the
interest of the convicted in absentia and the responsible for the civil rights and
its procedures are simple, to be decided before the competent official in the
court issuing the verdict in absentia, and this report is deemed a declaration for
it even if it is from a deputy in the Egyptian legislation and opposition entails
stopping the execution of the opposed verdict and reconsidering the case that
issued the opposed verdict, and the opposition demands the application of the
rule "the opposed must not be prejudiced with his opposition", also "judging
that the opposition is null", in case of not attending the determined opposition
session by the opposing one, and in this research I concluded what must be
done of procedures to amend the methods of declaration and simplifying their
procedures, and I proposed issuing several legislative amendments by the two
legislators the Libyan and the Egyptian, aiming at achieving justice and
facilitating it, as detailed in this research.
