مع ظهور شبكة الإنترنت استطاع في وقت قصير إن يجذب إليه أغلب دول العالم ، وتصاعد عدد مستخدميه بشكل ملحوظ ، خاصة في السنوات الأخيرة ، نظراً لما يقدمه للأفراد من خدمات ، لاسيما في مجال التجارة الالكترونية ، التي إنتشرت على نطاق كبير، ولم تعد خدماتها مقصورة على التعامل في السلع الملموسة، بل امتدت لتشمل النشر الرقمي بكافة أشكاله ، والتي يتم الحصول عليه عن طريق ما يسمى ببنوك المعلومات الالكترونية أو المكتبات الالكترونية أو مواقع الإنترنت المختلفة من خلال عقد النشر الالكتروني ، ونجد أهمية موضوع الدراسة في مدى إمكانية ايجاد السياج الذي يحمي المبدعين ويحقق تلك المعادلة الصعبة في أن تجد أفكارهم وإبداعاتهم النور وبين المحافظة على حقوقهم الأدبية والمالية ، ولكن هل كانت الحماية المرصودة لمواضيع الملكية الفكرية بصفة عامة وحقوق المؤلف بصفة خاصة كافية من الناحية القانونية على الصعيدين الدولي والوطني ؟ ومن أجل الاجابة عن هذا التساؤل جاءت أهمية موضوع الرسالة والخاصة بحماية حق المؤلف المنشور
