The study explains and analyzes the principle of the exception on carrying out the domestic and international administrative contracts which is showed special nature of administrative contract and its effect on legal system trough out traditional standard to discriminate administrative contract, and the effect of internationalization on this contract, and the situation of the Egyptian and French council of the state
Also, the study explains the declaration of legal system of the exception on carrying out and this is through what is it? The law base, the declaration of its limit, adherence to exception on carrying out, how to use, the implications of it for contractors or others and how to carrying out it by original attribute or dependence attribute
Then, the study explains the approach of Egyptian and French council of state which interest in exception on carrying out and with the determinants of Egyptian council of state attitudes at exception on carrying out although The Egyptian and French council of state is where they don't apply exception on carrying out except in limited cases
At the last, the study explains of the exception on carrying out the domestic and international administrative contracts by special nature of contracts where contractor's situation is sometimes stronger than administration side and usually the contractor determines the conditions which decrease the authority of administration side such as arbitration condition, stabilization of contract and legislative stabilization conditions.
The study concludes by the necessity of creating completed legal organization of exception on carrying out at administrative contracts which cares by the special nature of contracts.
