520	3		_aأدى التطور التكنولوجي الهائل والثورة الصناعية المعلوماتية إلى بزوغ تقنيات مُسْتَحْدَثة لم تكن موجودة من قبل، لعل من أهمها تقنية البلوك تشين Block chain أو ما يُعرف ب سلسلة الكتل الموزعة"، وهي قاعدة بيانات غير مركزية تستخدم لتخزين المعلومات بشكل متسلسل في صورة "كتل" (blocks) حيث تحتوي كل كتلة على مجموعة من البيانات أو المعاملات، ويكون التعديل على هذه البيانات أو المعلومات بعد إضافتها إلى البلوك تشين أمرًا أشبه بالاستحالة المطلقة، وهو ما أدى إلى تعدد استخدامات هذه التقنية في مختلف القطاعات ومنها القطاع المالي على وجه التحديد. فالعملات المشفرة تعد أحد أهم التطبيقات العملية لتقنية البلوك تشين، وقد باتت هذه العملات واقعا يفرض نفسه؛ وذلك لما تتميز به من سمات لا تتوافر لدى العملات التقليدية، كتمتعها بصفة اللا مركزية والتمرد على الرضوخ لأية رقابة مركزية، فضلا عن سرعة التعاملات التامة بها وقلة التكاليف المفروضة عليها مقارنة بالعملات التقليدية، إضافة إلى تحقيقها لأقصى درجة من درجات إخفاء الهوية وكتمان الشخصيات المتعاملين بها. بيد أن ما تتسم به هذه العملات المشفرة من مزايا، لم يجعلها سالمة من أيدي ضعاف النفوس والعصابات الإجرامية المنظمة، فأضحت بالنسبة لديهم وسيلة دفع رئيسية وفعالة في النطاق الباطني لشبكة الإنترنت المظلم، واستخدموها كأداة لدفع المقابل المادي نظير تقديم خدمات إجرامية متعددة، ومن هنا حازت العملات المشفرة على اهتمام العديد من أنظار المشرعين المحليين، وكذا الهيئات والمنظمات الدولية المعنية بمكافحة الجريمة لا سيما العابرة للحدود. وقد ثبت بالبرهان الدامغ وبالتطبيقات العملية انخراط العملات المشفرة في اقتراف عدة أنشطة إجرامية مؤثمة، وعلى وجه التحديد جريمتي غسل الأموال وتمويل الإرهاب، وهو ما دفع منظمة الأمم المتحدة - ممثلة في مكتبها المعني بمكافحة المخدرات والجريمة ومجموعة العمل المالي في إصدار عدة توصيات المجابهة الاستخدام الإجرامي لهذه العملات.
520	3		_aThe massive technological development and the information industrial revolution have led to the emergence of new technologies that did not exist before, perhaps the most important of which is blockchain technology, also known as the "distributed ledger technology". It is a decentralized database used to store information sequentially in the form of "blocks", where each block contains a set of data or transactions, and modifying this data or information after it is added to the blockchain is almost absolutely impossible, which has led to the multiplicity of uses of this technology in various sectors, including the financial sector in particular. Cryptocurrencies are one of the most important practical applications of blockchain technology, and these currencies have become a reality that cannot be ignored. This is due to their distinctive characteristics that are not available in traditional currencies, such as their decentralized nature and rejection of submission to any central control. In addition to the complete speed of transactions and the low costs imposed on them compared to traditional currencies, they also achieve the highest degree of anonymity and secrecy of the identities of those who deal with them. However, the advantages that these cryptocurrencies possess have not made them immune to the hands of the unscrupulous and organized crime gangs. They have become, for them, a major and effective means of payment in the underworld of the dark web, and they have used them as a tool to pay the material consideration for providing multiple criminal services. Hence, cryptocurrencies have attracted the attention of many local legislators, as well as international bodies and organizations concerned with combating crime, especially transnational crime. It has been proven with irrefutable evidence and practical applications that cryptocurrencies are involved in the commission of several criminal activities, specifically the crimes of money laundering and terrorist financing. This is what prompted the United Nations - represented by its Office on Drugs and Crime and the Financial Action Task Force to issue several recommendations to confront the criminal use of these currencies
