520	3		_aتعتبر البصمة الوراثية أبرز ما توصل إليه البحث العلمي البيولوجي وثمرة نتائجه، ولعل أهمية البصمة الوراثية ترجع إلى خصائصها المتعددة ، فالتشابه في تركيبها من شخص لآخر مستحيل سيما وأنه قد أمكن - مؤخراً - الفصل بين التوائم المتماثلة بفحصها بواسطة طرق مستحدثة ، فضلاً عن أنها متوارثة من كلا الأبوين مناصفة، كما تتنوع مصادر عيناتها ، فلا تتوقف عند نوعية معينة من العينات ، هذا إلى أنها تتحمل الظروف الجوية وغيرها من العوامل التي تؤثر في الأدلة المادية الأخرى، فضلا عن إمكانية التوصل لها حتى بعد وفاة الإنسان بتحليل العظم أو بقايا الأسنان لتحديد هويته ، وهو ما يميزها عن غيرها من بصمات. وعلى إثر هذا الاكتشاف وما قدمه صاحبه من إيضاحات بشأنه، فقد قدم أيضاً اقتراحات لمجالات الاستفادة منه، وهو ما تلقفه أهل البحث والاختصاص ببالغ الاهتمام، كل حسب اختصاصه وذلك على أمل تحقيق هذه الاستفادة للإسهام في تحقيق أهدافهم الساعين إليها، ومن هذه المجالات التي يستفاد من البصمة الوراثية فيها إثبات ونفي النسب والإثبات الجنائي. وإذا كان هذا الكشف العلمي الدقيق قد تم على يد من لا يدين بالإسلام ولا يتحدث العربية؛ فإنه من الواجب - وقبل اقتباسه - أسلمته وتعريبه برده إلى الإطار الشرعي والقانوني الذي يحكمنا، وذلك بالوقوف على تكييفه الشرعي بإرجاعه لأحكامه الجزئية وقواعده الكلية ومقاصده الشرعية في الشريعة الإسلامية والقانون، فكما للعلم أهمية له في ذات الوقت خطره وتأثيره على حياة الإنسان، فكم من ضال ظن أنه يحسن صنعًا، وذلك لعدم إدراكه عواقب وخطورة ما هو مقدم عليه وآثاره الوخيمة، وهو ما لا يمكن تدارك أثره إلا من خلال هذا التأصيل الشرعي والقانوني.
