| 520 | _aالحمد لله وحده، والصلاة والسلام على من لا نبي بعده، وعلى آله وأصحابه الغر الميامين، ومن تبعهم بإحسان إلى يوم الدين.. وبعد: فقد عالجت في رسالتي "عيوب الزوجين وأثرها على عقد النكاح" جملة من الأمور، والتي كانت من الأهمية بمكان، من أن الرسالة تناولت تحديد مفهوم العيوب من حيث هو في اللغة والاصطلاح، ثم كان الحديث عن مفهوم العيب بمعناه الخاص في النكاح، فعرَضَتِ الرسالة إلى تناول ذلك عند أربعة المذاهب الحنفية فالمالكية والشافعية والحنابلة، ثم كان رأي الباحث، ثم تناولت الرسالة التفريق بالعيب في الشرائع القديمة، فذكرت الفرقة بين الزوجين من خلال الشريعتين اليهودية والمسيحية، وصولًا إلى الحديث عن مفهوم عقد النكاح وشروطه وأركانه، والذي تناولت فيه التعريفات اللغوية والاصطلاحية وشرح المفردات، والأركان والحديث عنها. هذا، وقد تناول الباحث في رسالته أيضًا الحديث عن ثبوت حق التفريق بين الزوجين من حيث ثبوتُه في شريعتنا المباركة، وقد دلَّلَ على ذلك بمزيد من الأدلة، والتي تنوعت ما بين الاستدلال بالمنقول كالقرآن الكريم ووجه الاستدلال به، وكذلك السنة ووجوه الاستشهاد بها، والآثار عن السلف في ذلك، وما بين المعقول وكلام الفقهاء في ذلك، وذكر الباحث أيضًا التفريق بالعيب في قانون الأحوال الشخصية المصري، وأثبت موقف القانون في هذا مع شيء من الشرح. | ||

In his thesis, the researcher also discussed the establishment of the right to separate spouses in terms of its establishment in our blessed Sharia, and he demonstrated this with more evidence, which varied between inferences from narrations such as the Noble Qur'an and the means of inference from it, as well as the Sunnah and the ways in which it can be cited, and the narrations from The predecessors in this matter, and what Is reasonable and the words of the jurists in this regard, and the researcher also mentioned the distinction by defect in the Egyptian Personal Status Law, and proved the position of the law in this matter with some explanation. | ||
