520			_aيخلص الباحث في هذه الدراسة إلى أن الترخيص الإداري ما هو إلا وسيلة أو أسلوب من أساليب الإدارة لتحقيق غايات النظام العام تماماً مثل القرارات والعقود الإدارية، إلا أنه يختلف عنها في بعض الخصائص والسمات القانونية كما تختلف التراخيص الإدارية من حيث النوع ومن حيث السلطة الممنوحة للإدارة بإختلاف نوع النشاط الذي تريد تنظيمه، فتراخيص الأسلحة وذخائرها هي تراخيص متعلقة بتحقيق غايات الضبط الإداري لاسيما غاية الأمن العام، لذلك فقد أعطى المشرع المصري بالقانون رقم ٣٩٤ لسنة ١٩٥٤ لجهة الإدارة وزير الداخلية أو من ينيبه سلطة تقديرية واسعة النطاق في هذا الشأن ضماناً لحماية المجتمع من أخطار استعمال الأسلحة لاسيما النارية والاتجار بها، وإزاء هذه السلطة التقديرية واسعة النطاق كان لابد وأن يراقب مجلس الدولة المصري هذه السلطة في هذا المجال بالغ الخطورة والحساسية لتحقيق التوازن المطلوب بين حرية الدفاع عن النفس وحق المجتمع في ألا يتهدد السلم العام به، وكان من أهم أركان هذه الرقابة هي الرقابة على ركن السبب بتطورها الحديث، حيث نستطيع القول إن قضاء مجلس الدولة يخفف من رقابته على السبب في مجال تراخيص الاتجار بالأسلحة وذلك نظراً لطبيعة هذا النشاط الخطر على المجتمع وذلك على عكس رقابته على تراخيص حيازة وإحراز الأسلحة حيث تشدد في رقابته على مثل هذا النوع من التراخيص تحقيقاً للحرية المطلوبة.
520			_aIn this research, the author concludes the following points: 1. The Administration has several methods through which it can achieve and maintain public order, 2. One of these methods beside using administrative contracts- is the administrative licensing: 3. Administrative licensing differ from administrative contracts as the former is fully controlled and organized by the Administration, while the latter is to certain extent subject to the mutual agreement between the Administration and the other contracting party. 4. The firearms and ammunition licensing is strictly related to the purposes of achieving public order especially public security. Accordingly, in this kind of licenses, the Egyptian Legislator - by the Law No. 394 of the Year 1954- vested the Interior Minister(or his delegee) a broad discretionary powers. Such discretionary powers shall be used only to protect the society from the abuse of using and trading firearms. 5. The said discretionary power is not an absolute one, as the usage of which is subject to judicial review by the State Council Courts. 6. The judicial review is guaranteeing the balance between citizens' right to bear firearms for self defense purposes and the community's right to enjoy a peaceful life. 7. The judicial review aims at reviewing the legality of every single decision that restricts the firearm license. 8. From reviewing State Council Courts judgments, we can conclude that, in firearms trade licensing, the Administration is still has the upper hand and the State Council Courts are reluctant to perform a strict judicial review. While in firearms bearing licensing, State Council Courts are performing a strict judicial review to guarantee that the Administration is abusing its right and accordingly, prevents the citizens' from their rights of bearing firearms.
