520			_aتكمن أهمية الدراسة في أن حرية الرأي تعتبر جزءاً أصيلاً من حرية الإنسان، والتي هي من الحقوق الأساسية للإنسان أيا كان، وفي أي مكان، وهذا يتطلب مساحة من حرية الرأي تسمح بطرح صريح ومباشر لجميع المناحي المصيرية، ذات البعد السياسي والاقتصادي والاجتماعي. وتعد الحرية الفكرية والقدرة في التعبير عنها بكل الوسائل الممكنة، على اختلاف روافدها وفروعها؛ هي إحدى تجليات تطلع الأمم للتمدن والتحديث، والتطلع نحو آفاق الديمقراطية الرحبة، والسعي إلى تحقيق التقدم، فهي المنطق المنظم لها، ولا يماري بأنها من الثوابت والتي يتعين الدفاع عنها والتشبث بها، لأن الحقيقة الراسخة أن الإنسان هو معمر الأرض، وهي الأداة الأساسية لاستمرار وجوده فاعلاً بها، وهي من الحقوق القائمة حتى قيام الساعة. ولا يعزب عن البال أن كل إنسان يستطيع التعبير عن آرائه الخاصة، وأفكاره، سواء عبر عن فكره الفلسفي أو السياسي .... بمختلف وسائل النشر المتعددة، أو أية طريقة كانت، وذلك بحرية كاملة، وفي حدود عدم الإضرار بالغير أو بحريتهم. كما تكمن أهمية هذا الموضوع في أنه لم يدخل حيز التنظيم القانوني الممارسة حرية الرأي والتعبير من خلال شبكة المعلومات الدولية، ووجود فراغ تشريعي من شأنه أن ينظم استخدام الوسائط الإلكترونية في ممارسي تلك الحرية، بل أصبح الحق في التعبير عن الرأي في عصر تكنولوجيا المعلومات وعبر شبكة المعلومات الدولية وباستخدام وسائل التعبير الإلكترونية أحد حقوق الإنسان الرقمية التي يهتم بها المجتمع الدولي في الوقت الحاضر ويسعى جاهداً لحمايته دولياً. كما تتنوع صور التعبير عن الرأي إلكترونياً، وظهور التصويت الإلكتروني والصحافة الإلكترونية، مما يتعين معه معالجة المشاكل القانونية الناتجة عن ممارسة حرية الرأي والتعبير عبر هذه الوسائل الحديثة وتنظيمها بقوانين تتلاءم مع الطبيعة الخاصة لها.

Intellectual freedom and the ability to express it, by all possible means, in all its tributaries and branches; It is one of the manifestations of the nation's aspiration for civilization and modernization, the aspiration towards the broad horizons of democracy, and the pursuit of progress. His existence is effective in it, and it is one of the existing rights until the Hour. It does not escape the mind that every person can express his own opinions and ideas, whether he expresses his philosophical or political thought... by various means of publication, or any method whatsoever, with complete freedom, and within the limits of not harming others or their freedom. The importance of this topic also lies in the fact that it did not enter the scope of legal regulation of the exercise of freedom of opinion and expression through the international information network, and the existence of a legislative vacuum that would regulate the use of electronic media in the practitioners of that freedom. International information and the use of electronic means of expression is one of the digital human rights that the international community cares about at the present time and strives to protect it internationally. There are also various forms of electronic expression of opinion, and the emergence of electronic voting and electronic journalism, with which it is necessary to address the legal problems resulting from the exercise of freedom of opinion and expression through these modern means and their regulation by laws that are compatible with their special nature.
