520			_aظهرت الجريمة مع وجود البشرية ، وحتى يومنا الراهن لم تنتهي الجريمة في أي حضارة ، أو مجتمع على وجه الأرض ، فكانت نشأت العقوبة لارتباطها بالظاهرة الإجرامية والتي إرتبط وجودها بوجود المجتمع البشري ذاته ، فالعقوبة قديمة قدم المجتمع الإنساني باعتبارها تمثل رد الفعل ، أي تمثل إزاء من خالف قواعد السلوك الاجتماعي. وقد اتخذت العقوبة منذ القدم صوراً متباينة ، تطورت مع تطور الجماعة الإنسانية، وتطور معنى السلطة في الجماعة ، وكذلك تطور المنظور الديني في المجتمع ، وانتقال المجتمعات من مرحلة الزراعة إلى مرحلة الصناعة ، وخلال هذا المراحل الزمنية نشأت وتطورت العديد من المدارس الفكرية التي تؤسس لفكرة الحق في العقاب ، الأمر الذي يعتبر بداية النشأة الحقيقية لفكرة العقاب في العصور الحديثة. ونظراً لكون الفكر القانوني ذو طبيعة متطورة ومتجددة تواكب تطورات الإنسان من زمان إلى آخر، فقد ظهرت العقوبات السالبة للحرية ، ومن ثم انشأت السجون ليس فقط مكان لتنفيذ تلك العقوبات ، بل لترجمة فلسفة، وأهداف ، ووظيفة العقوبة إلى واقع تنفيذي ملموس من خلال تطبيق البرامج الإصلاحية والتأهيلية المتمثلة بتهذيب سلوك الجاني، وتثقيفه مهنياً ، ودينياً ، وتأهيله نفسياً ، ورعايته اجتماعياً ، وذلك لإعادة اندماجه في المجتمع.
